The act may be better known as the ‘vape mail ban,’ however, the effects go beyond prohibition on postal delivery.

According to Vaping360 “The Preventing Online Sales of E-Cigarettes to Children Act wasn’t new. It had already passed the House in October 2019 and the Senate in July 2020 in slightly different forms. CASAA issued a call to action for the bill before it passed the Senate in the summer, but few vapers or vaping businesses seemed especially alarmed by the prospect of its passage.

“The new law does two things:

“Instructs the U.S. Postal Service to create regulations prohibiting shipment of all vaping products through the U.S. Mail to residential addresses.

“Inserts vaping products into the Prevent All Cigarette Trafficking (PACT) Act. (The PACT Act is an amendment to the older federal Jenkins Act).”

Since the new law was passed and put into effect, all other major delivery companies have announced they will stop delivering vaping products to homes, as well as businesses. As these deadlines approach and when the US Post Office stops shipping vaping products, the vaping industry is working diligently to develop solutions that will allow consumers orders to be delivered, at least for many vapers.

All vaping retailers must verify the age of customers using a commercially available database, the private delivery service must collect an adult signature at the point of delivery. The retailer must be registered with the ATF and US Attorney General. Attain a state and local tax license in all localities business is conducted. Businesses must collect and pay all applicable local and state taxes, and affix any required tax stamps to the products sold. All transactions must be sent to each state’s tax administrator that includes the names and addresses of each customer sold to, the quantities and type of each product sold, and the name, address, and phone number of the person delivering the shipment to the recipient

The PACT Act “Prevent All Cigarette Trafficking (Pact) Act Agent Requirement

Per the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives:

“Any person who sells, transfers, or ships for profit cigarettes or smokeless tobacco in interstate commerce, whereby such cigarettes or smokeless tobacco are shipped into a State, locality, or Indian country of an Indian tribe taxing the sale or use of cigarettes or smokeless tobacco or who advertises or offers cigarettes or smokeless tobacco for such a sale, transfer, or shipment shall first file with the Attorney General of the United States and with the tobacco tax administrators of the State and place into which such shipment is made, advertised, or offer is disseminated.”

PACT Agent Requirement

In Section III on the Prevent All Cigarette Trafficking (PACT) Act form an “Agent Authorized to Accept Service” is required.
