Blaine Bortnick, Esq.<\/span>, managing partner of the New York<\/span> office for Rasco Klock<\/span>; along with James Halter, Esq<\/span>., special counsel to the firm; recently won a case on a motion to dismiss in federal court in New York City<\/span>, New York<\/span>. Bortnick’s client, Jan Gerner<\/span> of the Czech Republic<\/span> \u2015 among other defendants \u2015 filed the motion to dismiss a $1 billion<\/span> lawsuit brought by New York<\/span>-based hedge fund Kingstown Capital Management LP and its affiliates.<\/p>\n <\/p>\n Gerner had previously purchased publicly traded shares in ORCO Property Group, S.A., a Luxembourg<\/span>-based real estate development company, whose shares traded on European exchanges. ORCO’s controlling shareholder is Radovan Vitek<\/span>, who was also a defendant in the case.<\/p>\n <\/p>\n Kingstown<\/span> alleged that Vitek secretly acquired control over the ORCO board of directors and stripped ORCO of valuable assets to the detriment of minority shareholders like Kingstown<\/span>. Gerner, among other defendants, were alleged to have acted together with Vitek. Kingstown<\/span> had previously filed a similar action in Luxembourg<\/span>, although Gerner is not a defendant in that case. <\/p>\n Although their Luxembourg Action remained pending, the New York<\/span>-based investors of Kingstown<\/span> filed this Racketeer Influenced and Corrupt Organizations Act (RICO) action seeking recovery from Vitek and others for essentially the same misconduct litigated in the Luxembourg<\/span> case.<\/p>\n Along with the other defendants’ attorneys, Bortnick and Halter sought dismissal of Kingstown’s<\/span> claims on numerous grounds. <\/p>\n Relying on two of Rasco Klock’s<\/span> many arguments, U.S. District Judge Denise Cote<\/span> of the Southern District of New York<\/span> determined that the Luxembourg<\/span> action should take precedence and accordingly dismissed the New York<\/span> federal court case. As a result, she did not decide the other arguments in favor of the motion to dismiss.<\/p>\n “This $1 billion<\/span> case was an incredible win for Blaine and James,” said Ramón E.
