While implementation has been delayed, these changes will soon make the process more demanding.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201c<\/span><i><span style=\"font-weight: 400\">Carrying a firearm without an LTC, or even possessing one without proper documentation, can lead to felony charges<\/span><\/i><span style=\"font-weight: 400\">,\u201d Attorney Peterson explains. \u201c<\/span><i><span style=\"font-weight: 400\">The new law makes it even more critical to stay informed about licensing requirements.<\/span><\/i><span style=\"font-weight: 400\">\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Key Changes in Massachusetts Firearms Law\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The 2024 reforms introduced sweeping changes, including:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><b>Assault Weapon &amp; Magazine Ban:<\/b><span style=\"font-weight: 400\"> Firearms classified as assault weapons are prohibited, and magazines are limited to 10 rounds unless pre-1994.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>Ghost Guns Regulated:<\/b><span style=\"font-weight: 400\"> Homemade, unserialized firearms must now be serialized and registered.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>No Operability Proof Needed: <\/b><span style=\"font-weight: 400\">Prosecutors no longer need to prove a firearm was operable in unlawful possession cases.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>Polling Place Prohibition:<\/b><span style=\"font-weight: 400\"> Firearms are banned within 150 feet of polling locations.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>Expanded ERPOs (Red Flag Law):<\/b><span style=\"font-weight: 400\"> School officials and healthcare providers can now request Extreme Risk Protection Orders, even against individuals without an LTC.\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>Raised Age Requirement: <\/b><span style=\"font-weight: 400\">Legal age for owning semi-automatic rifles increased from 18 to 21.\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>Business Owner Restrictions:<\/b><span style=\"font-weight: 400\"> Non-resident business owners must obtain<\/span> <a href=\"https:\/\/mwpetersonlaw.com\/practice-areas\/firearms-and-gun-rights\/non-resident-temporary-ltc\/\"  rel=\"noopener\"><span style=\"font-weight: 400\">temporary<\/span> <span style=\"font-weight: 400\">licenses<\/span><\/a><span style=\"font-weight: 400\">; firearms must be registered.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>New Disqualifiers:<\/b><span style=\"font-weight: 400\"> Individuals with 258E harassment orders are now prohibited from firearm possession.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400\"><b>Broader Licensing Discretion:<\/b><span style=\"font-weight: 400\"> Authorities may deny licenses based on suitability using a wide range of evidence.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">\u201c<\/span><i><span style=\"font-weight: 400\">These changes create serious risks for well-intentioned gun owners who may not even realize they are in violation<\/span><\/i><span style=\"font-weight: 400\">,\u201d Peterson says. \u201c<\/span><i><span style=\"font-weight: 400\">Something as simple as an old magazine or an improperly registered firearm could now result in criminal charges.<\/span><\/i><span style=\"font-weight: 400\">\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Consequences of Firearms Offenses\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Massachusetts law imposes mandatory minimum sentences for many firearms charges, even for first-time offenders.
