The regulator, which oversees ride-hailing companies,&nbsp;<a href=\"https:\/\/www.sfchronicle.com\/business\/article\/California-regulators-say-Uber-Lyft-drivers-are-15330779.php\" target=\"_blank\" rel=\"noopener noreferrer\">declared<\/a>&nbsp;its decision in an&nbsp;<a href=\"https:\/\/docs.cpuc.ca.gov\/PublishedDocs\/Efile\/G000\/M339\/K545\/339545137.PDF\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a>&nbsp;published on Tuesday. It said &ldquo;a person providing labor or services for remuneration shall be considered an employee rather than an independent contractor&rdquo; under AB5, the state&rsquo;s new law covering gig work, which became effective on January 1st, 2020.<\/p>\n<p>In its order, the Commission mentioned that Uber&nbsp;<a href=\"https:\/\/www.engadget.com\/2019-12-30-uber-and-postmates-sue-california-over-ab5-gig-worker-law.html\" data-rapid_p=\"3\" data-v9y=\"1\">filed a lawsuit<\/a>&nbsp;in federal court to prevent its drivers from being classified as employees under AB5. It also noted that Uber and Lyft successfully &ldquo;placed on the November 2020 ballot a&nbsp;<a href=\"https:\/\/www.engadget.com\/2019-08-30-uber-lyft-60-million-ballot.html\" data-rapid_p=\"4\" data-v9y=\"0\">measure<\/a>&nbsp;that would exclude all app-based drivers from AB5.&rdquo; The lawsuit and ballot don&rsquo;t affect the Commission&rsquo;s authority over ride-hailing services, though, so their drivers are &ldquo;presumed to be employees.&rdquo; That means the regulator must ensure that ride-hailing services &ldquo;comply with those requirements that are applicable to the employees of an entity subject to the Commission&rsquo;s jurisdiction.&rdquo;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div class=\"o-article_block pb-15 pb-5@m- mt-n35 mt-n25@m mt-n15@s\">\n<div class=\"grid@tl+\">\n<div class=\"full-width@tp- grid@tl+__cell col-8-of-12@tl+\">\n<div class=\"article-text c-gray-1 no-review\">\n<p>Just last week, the regulator also warned the companies that they have to provide workers&rsquo; compensation for their employees by July 1st. If they don&rsquo;t comply, it could revoke their operating authority under state law. As&nbsp;<a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/uber-lyft-drivers-are-employees-california-regulatory-agency-finds-n1229616\" target=\"_blank\" rel=\"noopener noreferrer\"><em>NBC News<\/em><\/a>&nbsp;notes, it&rsquo;s unclear if this ruling can compel Uber and Lyft to formally reclassify their drivers.
