NAD determined that AI-Pro\u2019s modified claim \u201cPowered by OpenAI,\u201d \u201cPowered by ChatGPT Technology,\u201d accompanied by the disclosure \u201cIndependently developed and not affiliated, endorsed, or sponsored by OpenAI\u201d makes clear that AI-Pro uses ChatGPT technology in its product offerings and is not ChatGPT.<\/p>\n<p style=\"text-align: justify;\">However, NAD found that in contexts without the disclosure, or in which the disclosures are not clear and conspicuous, consumers can reasonably take away the message that AI-Pro\u2019s product or service is ChatGPT or is affiliated with OpenAI.<\/p>\n<p style=\"text-align: justify;\">Therefore, NAD recommended that:<\/p>\n<ul style=\"text-align: justify;\">\n<li>The disclosure \u201cAI-PRO is Powered by OpenAI.
