LOS ANGELES<\/span><\/span> \u2013 <\/span><\/span>Two companies have been ordered to pay <\/span><\/span>a<\/span><\/span>former Senior Vice President of Claims Litigation <\/span><\/span>$<\/span><\/span>155.4<\/span><\/span>million <\/span><\/span>in compensatory and punitive damages after he prevailed in his wrongful termination sui<\/span><\/span>t. <\/span><\/span><\/p>\n

The jury on Tuesday found that Farmers Group, <\/span><\/span>Inc.<\/span><\/span> and Farmers Insurance Exchange had retaliated aga<\/span><\/span>inst Andrew Rudnicki<\/span><\/span>, a devoted and decorated employee of 37-years, who was months away from his anticipated testimony in a case alleging claims under the Fair Employment and Housing Act (\u201cFEHA\u201d) (<\/span><\/span>Coates v. Farmers<\/span><\/span>). <\/span><\/span><\/p>\n

Fearful<\/span><\/span> that<\/span><\/span> his testimony that would have shed light on inaction by Farmers<\/span><\/span>, <\/span><\/span>Farmers retaliated against Rudnicki and shamefully used him as a scapegoat <\/span><\/span>in order to<\/span><\/span> hide their own failure to address concerns Rudnicki raised on behalf of the eventual\u00a0<\/span><\/span>Coates\u00a0<\/span><\/span>p<\/span><\/span>laintiff<\/span><\/span>s<\/span><\/span> that <\/span><\/span>led<\/span><\/span> to the\u00a0<\/span><\/span>Coates\u00a0<\/span><\/span>litigation.<\/span><\/span><\/p>\n

The <\/span><\/span>j<\/span><\/span>ury agreed<\/span><\/span>.<\/span><\/span> On Tuesday, <\/span><\/span>Rudnicki<\/span><\/span> was<\/span><\/span> awarded<\/span><\/span> $5.4<\/span><\/span>million<\/span><\/span> in compensatory damages<\/span><\/span>. The jury also concluded that an officer, director or managing agent of at least one of the defendants acted with malice, <\/span><\/span>oppression<\/span><\/span> or fraud against Rudnicki, triggering a second phase of the trial. <\/span><\/span><\/p>\n

On Thursday, the punitive damages phase of the trial got underway. Following its conclusion, and within <\/span><\/span>less than<\/span><\/span> forty minutes, a jury awarded Rudnicki <\/span><\/span>a groundbreaking punitive damages award of $150<\/span><\/span> million <\/span><\/span>against Farmers Insurance Exchange and Farmers Group Inc.<\/span><\/span><\/p>\n

The verdict is believed to be among the <\/span><\/span>highest<\/span><\/span> in the state of California alleging similar claims.<\/span><\/span><\/p>\n

The lawsuit <\/span><\/span>had<\/span><\/span> been<\/span><\/span> filed<\/span><\/span> and tried<\/span><\/span> by Shegerian and Associates<\/span><\/span> on behalf of <\/span><\/span>Rudnicki in Los Angeles Superior Court (Case No. <\/span><\/span>BC630158).<\/span><\/span><\/p>\n
