See\u00a0<\/span><span style=\"font-weight: 400;\">Shapiro v. Welt<\/span><span style=\"font-weight: 400;\">, 389 P.3d 262, 268 (Nev. 2017)\u00a0<\/span><br \/>\n<span style=\"font-weight: 400;\">&#8220;Based on its legislative history, the original intent of the anti-SLAPP motion was to encourage public participation. The anti-SLAPP motion to dismiss was designed to allow people to speak out against wrongdoings without being afraid that the defendant would engage in expensive legal maneuvers and machinations, solely for the purpose of wearing down (and possibly bankrupting) the plaintiff.&#8221;\u00a0<\/span><span style=\"font-weight: 400;\">\u00a0\u00a0<\/span><a href=\"http:\/\/rutgerspolicyjournal.org\/sites\/jlpp\/files\/Golden.pdf\" target=\"_blank\" rel=\"noopener\"> Nina Golden, SLAPP Down: The Use (and Abuse) of Anti-SLAPP Motions to Strike, 12 Rutgers J. L. &amp; Pub. Pol\u2019y 426, 427 (2015)<\/a><span style=\"font-weight: 400;\">Walker claims the application of Anti-SLAPP statutes in federal courts is becoming murkier with each coming new appellate opinion.\u00a0 \u00a0&#8220;Corporations and the Courts have flipped the original intent of the statute in allowing big corporations to use them <\/span><em><span style=\"font-weight: 400;\">against <\/span><\/em><span style=\"font-weight: 400;\">news organizations and average people in various types of suits in which those corporations were supposed to face trial for misconduct or owing people money&#8221;, he says.\u00a0 In fact, as recently in 2019, a Court had to consider the \u00a0 \u201cthe statute\u2019s application to employment <\/span><em><span style=\"font-weight: 400;\">discrimination<\/span><\/em><span style=\"font-weight: 400;\"> and <\/span><em><span style=\"font-weight: 400;\">retaliation<\/span><\/em><span style=\"font-weight: 400;\"> claims\u201d Wilson v. Cable News Network, Inc., 7 Cal.5th 871, 881 (Cal. 2019)\u00a0\u00a0<\/span><br \/>\n<span style=\"font-weight: 400;\">A key question Walker is asking is,\u00a0\u00a0<\/span><br \/>\n<span style=\"font-weight: 400;\">\u00a0&#8220;How did SLAPP cases metamorphose from suits where large corporations were trying to silence the public, whether or not their cases had merit, to large corporations using the anti-SLAPP motion to silence the public?&#8221; <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><a href=\"https:\/\/rutgerspolicyjournal.org\/sites\/jlpp\/files\/Golden.pdf\" target=\"_blank\" rel=\"noopener\">SLAPP DOWN: THE USE (AND ABUSE) OF ANTI-SLAPP MOTIONS TO STRIKE Assoc. Intelli-heart Servs., Inc.<\/span><\/em><span style=\"font-weight: 400;\">, Case No. 3:18-cv-00132-MMD-CLC in the U.S. District Court of Nevada.\u00a0<\/span><br \/>\n<span style=\"font-weight: 400;\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter\" style=\"margin-left: auto; margin-right: auto;\" src=\"https:\/\/law.icrowdnewswire.com\/assets\/source\/users\/2536\/court.jpg?1638207655408\" alt=\"court\" width=\"381\" height=\"238\" title=\"Supreme Court Petition claims Anti-Slapp law was used to Cover-up Government Contractor\u2019s False Statements to a Federal Agency about its Failure to Pay 13\"><\/span><br \/>\n<span style=\"font-weight: 400;\">The District Court of Nevada first described\u00a0 Walker&#8217;s lawsuit as being about\u00a0<\/span><em><span style=\"font-weight: 400;\">money<\/span><\/em><span style=\"font-weight: 400;\">,<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u201cAccording to Walker, Intelli-Heart was routinely late in paying Winters his commission payments on the VA contracts he helped Winters secure. As a result, Winters was late paying Walker. (ECF No. 4, \u00b6 39-53). By November 2017, the payments to Winters were approximately 120 days late. (<\/span><em><span style=\"font-weight: 400;\">Id<\/span><\/em><span style=\"font-weight: 400;\">.) Due to the late payments******\u201cIntelli-Heart cancelled its contract with Winters. Walker claims Intelli-Heart improperly cancelled its contract with Winters, which resulted in the breach of the agreement between himself and Winters.\u201d <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><a href=\"https:\/\/casetext.com\/case\/walker-v-intelli-heart-servs-inc-1\" target=\"_blank\" rel=\"noopener\">Walker v. Apr. 9, 2019)\u00a0<\/a><\/p>\n<p><span style=\"font-weight: 400;\">Yet,\u00a0 after the government contractor and their co-Defendants filed Anti-Slapp motions, the U.S. District Court judge Miranda Du subsequently held,\u00a0<\/span><br \/>\n<span style=\"font-weight: 400;\">\u201cPlaintiff&#8217;s Complaint is based entirely on Defendants&#8217; <\/span><em><span style=\"font-weight: 400;\">good faith communications<\/span><\/em><span style=\"font-weight: 400;\"> in furtherance of their right to petition or free speech in connection with an issue of public concern\u201d <\/span><a href=\"https:\/\/casetext.com\/case\/walker-v-intelli-heart-servs-inc-4\" target=\"_blank\" rel=\"noopener\">Walker v. Intelli-heart Servs., Inc., Case No. 3:18-cv-00132-MMD-CLC, *6 (D. Nev. Mar. 4, 2020).<\/a><\/p>\n<p style=\"text-align: center;\"><img decoding=\"async\" src=\"https:\/\/law.icrowdnewswire.com\/assets\/source\/users\/2536\/What%20Huh%20GIF%20-%20What%20Huh%20Dogs%20-%20Discover%20%26%20Share%20GIFs.gif?1638209642793\" alt=\"What Huh GIF - What Huh Dogs - Discover &amp; Share GIFs\" title=\"Supreme Court Petition claims Anti-Slapp law was used to Cover-up Government Contractor\u2019s False Statements to a Federal Agency about its Failure to Pay 14\"><\/p>\n<p><span style=\"font-weight: 400;\">According to Walker, the District Court &#8212; without granting Walker an opportunity to discover <\/span><em><span style=\"font-weight: 400;\">any<\/span><\/em><span style=\"font-weight: 400;\"> evidence on these &#8220;good faith communications&#8221; &#8212; entered a judgment. Yet, it acknowledged,<\/span><br \/>\n<span style=\"font-weight: 400;\">\u201c the Court is required to <\/span><em><span style=\"font-weight: 400;\">consider evidence<\/span><\/em><span style=\"font-weight: 400;\"> in making a determination under these paragraphs. <\/span><em><span style=\"font-weight: 400;\">See<\/span><\/em> <span style=\"font-weight: 400;\">NRS \u00a7 41.660(3)(d)<\/span><span style=\"font-weight: 400;\">\u201d <a href=\"https:\/\/casetext.com\/case\/walker-v-intelli-heart-servs-inc-4\" target=\"_blank\" rel=\"noopener\">Walker v. Mar. 4, 2020).<\/a><\/span><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter\" style=\"margin-left: auto; margin-right: auto;\" src=\"https:\/\/law.icrowdnewswire.com\/assets\/source\/users\/2536\/BeFunky-photo.jpg?1638415722797\" alt=\"BeFunky-photo\" width=\"496\" height=\"251\" title=\"Supreme Court Petition claims Anti-Slapp law was used to Cover-up Government Contractor\u2019s False Statements to a Federal Agency about its Failure to Pay 15\"><br \/>\n<span style=\"font-weight: 400;\">Walker (in his brief in Ninth Circuit <a href=\"https:\/\/drive.google.com\/file\/d\/1FG_wy6595XUFfl14TIeBlSfAYzxPxJs0\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">case 20-15688<\/a>) and another party in a different U.S. Ninth Circuit Court of Appeals case (<a href=\"https:\/\/casetext.com\/case\/fennell-v-bonta\" target=\"_blank\" rel=\"noopener\">Doug FENNELL v. Rob Bonta 20-16487<\/a>) addressed these failings,<\/span><br \/>\n<span style=\"font-weight: 400;\">\u201c anti-SLAPP laws in general are depriving Plaintiffs access to courts and trial by jury as judges are making decisions before discovery or evidence is submitted.\u201d.\u00a0 Doug FENNELL v. Rob Bonta 20-16487, (9th Cir. 2021)(Dkt 18, pg 5)\u00a0<\/span><br \/>\n<span style=\"font-weight: 400;\">As one lawyer noted,\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">&#8220;Time and time again, opinions have restated the principle that \u2018[t]he court does not weigh evidence or resolve conflicting factual claims&#8217; in prong two. (<\/span><em><span style=\"font-weight: 400;\">Monster Energy Co. v. Schechter<\/span><\/em><span style=\"font-weight: 400;\"> (2019) 7 Cal.5th 781, 788.) As it turns out, however, if the courts don\u2019t exactly weigh evidence, they seem to engage in a process <\/span><em><span style=\"font-weight: 400;\">very much like weighing evidence or resolving conflicts in the evidence all the time in the anti-SLAPP context<\/span><\/em><span style=\"font-weight: 400;\">.\u2019 &#8221;\u00a0<\/span><a href=\"https:\/\/www.advocatemagazine.com\/article\/2020-may\/the-anti-slapp-statute-in-2020\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">https:\/\/www.advocatemagazine.com\/article\/2020-may\/the-anti-slapp-statute-in-2020<\/span><\/a><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The District Court judge in Walker&#8217;s case considered \u201cevidence\u201d but in the Ninth Circuit appeal,\u00a0<\/span><em><span style=\"font-weight: 400;\">Walker v. Intelli-Heart Services.<\/span><\/em><span style=\"font-weight: 400;\">, 20-15688, (9th Cir. Sep. 23, 2021), the Circuit panel called what the District Court did, weighing\u00a0\u00a0<\/span><a href=\"https:\/\/casetext.com\/case\/walker-v-intelli-heart-servs-6\" target=\"_blank\" rel=\"noopener\">\u201clegal deficiencies&#8221;.<\/a><br \/>\n<span style=\"font-weight: 400;\">Walker\u00a0claimed Intelli-heart was using Anti-Slapp law to shield itself of a \u201cpotential&#8221; <a href=\"https:\/\/drive.google.com\/file\/d\/1Eh43gUad0AHdELDzDnHNCZmu3CfNlMF3\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">federal crime<\/a> , citing U.S. v. Bazantes 978 F.3d 1227 (11th Cir 2020)(Affirming conviction of a federal contractor under the False Statements Act of person(s) who &#8220;submitted to the agency certified payroll forms containing false, fictitious, and fraudulent statements&#8221; Title 18 \u00a7 1001(a)(3)).\u00a0 Walker alluded to <a href=\"https:\/\/drive.google.com\/file\/d\/17IN58arHwZmzMCh9pNmxS-_Q0IQunuTT\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">another complaint<\/a> by Intelli-heart Services worker Dexter Devera that alleged the Intelli-heart had long been making late payments and bouncing checks as a matter of policy.\u00a0 Walker claimed, thus, that Intelli-heart&#8217;s statements to the VA that it was making timely payments could not have been good faith.<\/span><br \/>\n<span style=\"font-weight: 400;\">Even though the District Court found it critical to its &#8220;good faith communications&#8221; analysis that &#8220;<a href=\"https:\/\/casetext.com\/case\/walker-v-intelli-heart-servs-inc-4\" target=\"_blank\" rel=\"noopener\">Defendants&#8217; communications were at least made without knowledge they contained any false statements<\/a>&#8220;, the Ninth Circuit did an another about-face.\u00a0 \u00a0After Dexter Devera&#8217;s revelations (showing that IHS knew it was making late payments but stating otherwise), the Ninth Circuit charted a different course claiming,<\/span><br \/>\n<span style=\"font-weight: 400;\">\u201cWalker&#8217;s assertion that Defendants made <\/span><em><span style=\"font-weight: 400;\">false statements<\/span><\/em><span style=\"font-weight: 400;\"> to the VA about the timeliness of their payments to non-party James Winters <\/span><em><span style=\"font-weight: 400;\">is beside the point<\/span><\/em><span style=\"font-weight: 400;\">;\u201d\u00a0\u00a0<\/span><a href=\"https:\/\/casetext.com\/case\/walker-v-intelli-heart-servs-6\" target=\"_blank\" rel=\"noopener\">Walker v. Intelli-Heart Servs., 20-15688, (9th Cir. Sep. 23, 2021)<\/a><br \/>\n<img decoding=\"async\" loading=\"lazy\" class=\"aligncenter\" style=\"margin-left: auto; margin-right: auto;\" src=\"https:\/\/law.icrowdnewswire.com\/assets\/source\/users\/2536\/secret-life-of-pets-rabbit.gif?1638208957753\" alt=\"secret-life-of-pets-rabbit\" width=\"284\" height=\"313\" title=\"Supreme Court Petition claims Anti-Slapp law was used to Cover-up Government Contractor\u2019s False Statements to a Federal Agency about its Failure to Pay 16\"><br \/>\n<span style=\"font-weight: 400;\">Walker filed a <a href=\"https:\/\/drive.google.com\/file\/d\/1Eh43gUad0AHdELDzDnHNCZmu3CfNlMF3\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">Rehearing Petition<\/a> on Sept 24, 2021 in the Ninth Circuit addressing these issues, but rehearing was denied on Oct. 27, 2021.\u00a0 &#8220;Not suprising&#8221;, says Walker who has been writing legal briefs for himself and lawyers for almost 30 years, as well as hosting a public access show segment on\u00a0 <a href=\"https:\/\/www.youtube.com\/watch?v=uRU1PZcu0B8&amp;feature=youtu.be\" target=\"_blank\" rel=\"noopener\">judicial corruption<\/a>. &#8220;I knew\u00a0<em>the fix<\/em> was in as soon as discovery was stayed by the Magistrate, out-of-the blue, which has no legal support. This was done\u00a0<strong>before<\/strong> the Anti-Slapp motions were filed, indicating to me that Nevada must have a <a href=\"https:\/\/dworkenlaw.com\/what-is-the-shadow-docket-and-why-is-it-important\/\" target=\"_blank\" rel=\"noopener\">shadow docket<\/a> of its own.\u00a0Then, the District Court judge ignored every argument in my <a href=\"https:\/\/drive.google.com\/file\/d\/1aws5q4foYBIhqgcnj3qbp3mwbydQk94K\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">40 page opposition<\/a> <em>claiming<\/em> she couldn&#8217;t understand it or it was over 24 pages, when she is the one that agreed I could file a <a href=\"https:\/\/drive.google.com\/file\/d\/1XONIK-c0zTq7ppNXi2Jqbf2ewaeaadSB\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">40 page opposition<\/a>.\u00a0 She chose to ignore the <a href=\"https:\/\/drive.google.com\/file\/d\/1eR3lpnWyOE9gCBJgOq-Az4iAR1HEkIkM\/view?usp=sharing\" target=\"_blank\" rel=\"noopener\">record and contracts<\/a>, as well. She is another <strong>Duck Dodgers<\/strong> &#8212; a phrase I coined a decade ago on <a href=\"https:\/\/www.youtube.com\/watch?v=uRU1PZcu0B8&amp;feature=youtu.be\" target=\"_blank\" rel=\"noopener\">my show<\/a>\u00a0in response to judicial officers who duck issues to get to their desired result.
