Dementia sufferer\u2019s case highlights larger problems<\/strong><\/p>\n

69 year old invalid and dementia victim\u00a0Stuart Crawford\u2019s case was\u00a0reported in the Telegraph<\/a>, and it is disturbing reading.\u00a0\u00a0CLC<\/a>\u00a0salespeople have\u00a0sold and upgraded<\/a>\u00a0the clearly vulnerable Crawford to the point where he has \u00a345k of debt, \u00a3700 a month payments, is forced into local authority accommodation, is unable to sell the membership and likely to leave his wife destitute when he dies.<\/p>\n

Nobody is buying<\/strong><\/p>\n

\u201cTimeshare has\u00a0<\/em>been struggling<\/em><\/a>\u00a0for years,\u201d\u00a0<\/em>explains Jack Dawson,\u00a0senior contracts adviser\u00a0for\u00a0European Consumer Claims<\/a>\u00a0(ECC).\u00a0\u00a0\u201cCompared to the rest of the travel industry it is\u00a0<\/em>expensive and inflexible<\/em><\/a>.\u00a0 During\u00a0<\/em>the pandemic<\/em><\/a>, members are paying full\u00a0 price, for holidays they can\u2019t take.\u00a0 People are desperate to\u00a0<\/em>escape this commitment<\/em><\/a>, and new member sales are bottoming out all over Europe.<\/em><\/p>\n

\u201cIt is deplorable, but not surprising that companies like CLC are behaving in this manner.\u201d<\/em><\/p>\n

Consumer laws ignored<\/strong><\/p>\n

\u201cIn 1999 legislation was enacted to protect consumers,\u201d\u00a0<\/em>continues Dawson.\u00a0\u00a0\u201cIt covered a lot of areas, including resorts no longer being allowed to take deposits on the day and contract terms not being allowed to be for over 50 years.\u00a0\u00a0<\/em><\/p>\n

\u201cWith falling sales, timeshare companies ignored these laws and got away with it for years.\u00a0 \u00a0Consumers aware their contracts were illegal had no way of navigating the Spanish legal system.\u201d\u00a0<\/em><\/p>\n

\"\"<\/p>\n

Compensation floodgates open<\/strong><\/p>\n

Andrew Cooper, CEO of ECC believes there is light at the end of the tunnel for mis-sold timeshare owners.\u00a0\u00a0\u201cThe resorts have been fighting tooth and nail to avoid having to\u00a0<\/em>compensate their victims<\/em><\/a>,\u201d\u00a0<\/em>he says.\u00a0\u00a0\u201cThey have employed\u00a0<\/em>every delaying tactic<\/em><\/a>\u00a0possible, but our firm and others have stayed the course.\u00a0 The timeshare companies are out of options and staggering amounts of compensation payments are now being awarded\u00a0against them.<\/em><\/p>\n

\u201cOur associated firm of lawyers, M1 Legal, just posted a\u00a0<\/em>record week<\/em><\/a>\u00a0of over \u00a3400,000 awarded to 21 happyformer owners from 7 different timeshare companies.<\/em><\/p>\n

\u201c\u00a3144,500 of this was in ten separate victories\u00a0against CLC, the resort which left Mr Crawford in such a desperate position.<\/em><\/p>\n

Cooper continues,\u00a0\u00a0\u201citmeshare companies have nowhere to hide.\u00a0 The precedents are set and the process is now streamlined, making it easier to claim.<\/em><\/p>\n

Be cautious when choosing a claims firm<\/strong><\/p>\n

\u201cSadly the timeshare claims business attracts many fraudulent firms who promise to get compensation for mis-sold members,\u201d\u00a0<\/em>warns Cooper.\u00a0 \u201cDon\u2019t just Google the subject and pick a firm with a flashy website.\u00a0 If you can get a\u00a0<\/em>recommendation<\/em><\/a>\u00a0from another\u00a0owner who was successfully awarded compensation, that firm is obviously worth trusting.<\/em><\/p>\n
