(&#8220;Wyeth&#8221;) regarding the prescription hormone replacement therapy medications Premarin, Prempro, and Premphase.<\/p>\n<p><strong>What is this case about?<\/strong>&nbsp;The lawsuit claims that Wyeth violated&nbsp;<span class=\"xn-location\">California<\/span>&nbsp;laws by misstating the benefits and\/or failing to disclose the risks of Premarin, Prempro, and Premphase purchased in&nbsp;<span class=\"xn-location\">California<\/span>&nbsp;between&nbsp;<span class=\"xn-chron\">January 1995<\/span>&nbsp;and January 2003.&nbsp; Wyeth denies it did anything wrong.&nbsp;<\/p>\n<p><strong>Who is included?<\/strong>&nbsp;An individual is included in this Settlement as a Class Member if they:<\/p>\n<ul>\n<li>Lived in&nbsp;<span class=\"xn-location\">California<\/span>&nbsp;between&nbsp;<span class=\"xn-chron\">January 1995<\/span>&nbsp;and&nbsp;<span class=\"xn-chron\">January 2003<\/span>;<\/li>\n<li>Bought Premarin, Prempro, and\/or Premphase in&nbsp;<span class=\"xn-location\">California<\/span>&nbsp;between&nbsp;<span class=\"xn-chron\">January 1995<\/span>&nbsp;and&nbsp;<span class=\"xn-chron\">January 2003<\/span>; and,<\/li>\n<li>Are not claiming any personal injury from the use of Prempro, Premarin, and\/or Premphase.<\/li>\n<\/ul>\n<p><strong>What Can a Class Member Get from the Settlement?&nbsp;<\/strong>There are two options to get money from the Settlement:<\/p>\n<p><u>Option 1<\/u>:&nbsp;receive a one-time payment of&nbsp;<span class=\"xn-money\">$458.64<\/span>.&nbsp; This amount is equivalent to the average out-of-pocket cost of Premarin, Prempro, and Premphase between&nbsp;<span class=\"xn-chron\">January 1995<\/span>&nbsp;and&nbsp;<span class=\"xn-chron\">January 2003<\/span>, multiplied by 24-months and adjusted for inflation.&nbsp; With inflation, the average cost is&nbsp;<span class=\"xn-money\">$19.11<\/span>&nbsp;per month. Claim must be supported by a sworn statement with information about prescriptions and purchases.&nbsp;<\/p>\n<p><u>Option 2<\/u>: receive a one-time payment of&nbsp;<span class=\"xn-money\">$19.11<\/span>&nbsp;for each and every month a Class Member purchased Premarin, Prempro and\/or Premphase between 1995 and&nbsp;<span class=\"xn-chron\">January 2003<\/span>&nbsp;(up to a maximum of 97 months or,&nbsp;<span class=\"xn-money\">$1,853.67<\/span>). Claim must be supported by proof of purchases.<\/p>\n<p><strong>How Can Class Members Get a Payment?&nbsp;<\/strong>Class Members&nbsp;must submit a valid Claim Form by mail or online at&nbsp;www.CaliforniaHRTClass.com&nbsp;by&nbsp;<strong><span class=\"xn-chron\">September 1, 2020<\/span><\/strong>&nbsp;to get a payment.<\/p>\n<p><strong>What Rights Do Class Members Have?&nbsp;<\/strong>If a Class Member does nothing, they will be bound by the Court&#8217;s decisions and will get no money.&nbsp; As described above, if they want to get money from the Settlement, they must file a claim. If they want to keep their right to sue Wyeth and get no money from the Settlement, they must exclude themselves from the Class by&nbsp;<strong><span class=\"xn-chron\">July 14, 2020<\/span><\/strong>.&nbsp; If they stay in the Settlement, they may object to it in writing by&nbsp;<strong><span class=\"xn-chron\">July 14, 2020<\/span><\/strong>.
